NRS 113: Nevada's Seller Disclosure Requirements

Under NRS 113.130, sellers of residential property with up to four units must provide buyers with a detailed disclosure form covering known defects, water damage, structural issues, environmental hazards, and neighborhood nuisances. Unlike California's extensive TDS and NHD requirements under Civil Code 1102, Nevada's disclosure framework is somewhat narrower — but the penalties for fraudulent non-disclosure are severe.

We see disclosure violations most frequently in fast-moving markets where sellers are tempted to hide foundation problems, water intrusion, or unpermitted construction to keep deals on track. If you purchased a property and discovered defects the seller knew about and concealed, you have legal remedies — but you need to act quickly.

HOA Disputes Under NRS 116

Nevada has one of the most extensive HOA frameworks in the country under NRS 116, the Uniform Common-Interest Ownership Act. This is especially significant in Las Vegas, where master-planned communities with mandatory HOA membership dominate the housing landscape — Summerlin, Henderson, and virtually every new development.

NRS 116 governs everything from assessment liens and foreclosure procedures to board governance and owner rights. HOA boards sometimes overreach — imposing excessive fines, selectively enforcing rules, or foreclosing on homes for relatively small assessment balances. Nevada's HOA super-priority lien (NRS 116.3116) is particularly aggressive: the first nine months of unpaid HOA assessments take priority over even a first mortgage. The State Engineer controls water appropriation, and disputes over surface water, groundwater, and water right transfers can make or break a development project or agricultural operation.

Nevada vs. California: Property Tax and Real Estate Law

Nevada has no state income tax, which drives significant real estate investment from California buyers — but property tax works differently. Nevada's property tax rate is lower than California's in most counties, and NRS 361.4722 caps annual property tax increases at 3% for primary residences and 8% for all other property. This is more predictable than California's Prop 13 reassessment triggers.
